for the InstantCard vCard service

These Terms and Conditions (“Terms”) govern the use of the InstantCard vCard service provided by BrightCard Inc. dba InstantCard (“we,” “us,” or “our”). By accessing or using our service, you agree to these Terms. Please read them carefully before proceeding.

Service Description

The InstantCard vCard service allows users to create virtual business cards (vCards) which are printed with a QR code and encoded using NFC technology.  After your vCard data has been entered and verified by you, your card can be ordered online, and will be printed and mailed to the address you specify.

User Responsibilities

Users are responsible for providing accurate information for their vCards and complying with these Terms. We are not responsible for any information which is incorrectly entered or invalid in any way.  Any misuse of the service is strictly prohibited.

Intellectual Property

All intellectual property rights related to this vCard service, QR codes, and NFC encoding belong to BrightCard Inc. Users are granted a limited, non-exclusive license to use the service.

Privacy Policy

We collect, use, and protect user data in accordance with our Privacy Policy. By using our service, you consent to the collection and use of your data as described therein.

Security Measures

We employ industry-standard security measures to protect user information and prevent unauthorized access.  Please refer to our Privacy Policy for further information.

Limitation of Liability

We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use or inability to use our vCard service, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all damages exceed the total amount paid by you for the service. This limitation of liability applies to the fullest extent permitted by law and shall survive any termination or expiration of these Terms.

Refund Policy

We do not offer refunds for vCard orders. However, in the event that you receive a defective card, you may request a replacement. To qualify for a replacement, the defective card must be returned to us, and we will verify the defect. If the card is deemed to be defective, we will provide a replacement at no additional cost to you. Please note that this policy applies solely to defects in materials or workmanship and does not cover errors or inaccuracies in the information provided by the user during the ordering process.

Inappropriate or Unauthorized Use

We are not responsible for any inappropriate or unauthorized use of our vCard service. Users are solely responsible for ensuring that their use of the service complies with applicable laws, regulations, and ethical standards. We reserve the right to suspend or terminate access to the service for any user found to be engaging in inappropriate or unauthorized activities, without prior notice. Additionally, we disclaim any liability for any damages or losses arising from such inappropriate or unauthorized use of the service.

Termination

We reserve the right to terminate user accounts or access to the service at our discretion, without prior notice, if users violate these Terms.

Governing Law

These Terms are governed by the laws of the State of Maryland. Any disputes arising under these Terms shall be resolved in the courts of State of Maryland.

Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website.
